Emotional Tour Live Experience

WELLNESS LIABILITY WAIVER & AGREEMENT

Completing this waiver is essential for me to provide services to you and to maintain/comply with my insurance as a business owner in the state of New York as a wellness consultant/coach. You are free to decline.

In consideration for Yvette Gorman-Holmes allowing me to voluntarily participate in a live or recorded Activity, I agree, by typing my full name below, on behalf of myself, my personal representatives, heirs, executors, administrators, agents, and assigns, to: Receive services from Yvette Gorman-Holmes in the role as a Life & Health Coach, Trainer, intenSati Leader and Emotional Tour Attuned Teacher and Ageless Grace Educator®.

ASSUMPTION OF RISKS

I understand that my participation in intenSati, Emotional Tour or Ageless Grace® classes and/or events (hereinafter the "Activity") may require that I engage in strenuous physical exercise or activity, including but not limited to strength training, flexibility development, dance, aerobic exercise and, personal training, while online in my own space, I do so at my own risk and assume the risk of all injury and/or damage I may suffer. This creates possible risks, dangers, and hazards, including the risk of severe or fatal injury to myself or others. I further understand that these risks, dangers, and hazards include those associated with travel to and from the location(s) to be visited during the Activity. I understand the risks, dangers, and hazards involved.

MENTAL & PHYSICAL HEALTH

Yvette Gorman-Holmes is not a licensed therapist or mental health counselor. If I, am under the care of a therapist, it is my responsibility to inform my therapist or counselor of my participation in personal development programs that may trigger emotions or experiences which may be challenging to manage.

This includes, without limitation, any and all claims for personal or bodily injuries, death or property damage, WHETHER CAUSED BY THE NEGLIGENCE OR CARELESSNESS OF Yvette Gorman-Holmes OR OTHERWISE, except to the extent caused by Yvette Gorman-Holmes’ gross negligence or intentional misconduct. This waiver and release of liability includes, without limitation, injuries which may occur as a result of (a) my use of any exercise equipment or facilities which may malfunction or break, (b) improper maintenance of any exercise equipment, premises or facilities, (c) negligent instruction or supervision, (d) negligent hiring or retention of employees, and/or (e) slipping or tripping and falling while on any portion of a premises or while traveling to or from any movement events, intenSati, Emotional Tour and Ageless Grace activities, including injuries resulting from Yvette Gorman-Holmes’ or anyone else’s negligent inspection or maintenance of the facility or premises.

DEFEND, HOLD HARMLESS AND INDEMNIFY

Yvette Gorman-Holmes from any and all claims, demands, causes of action, damages, liabilities, expenses (including, without limitation, any attorney's fees and costs), suits, actions and/or judgments made or brought by any party that may arise out of or in connection with my participation in the Activity. This includes, without limitation, any and all claims for personal or bodily injuries, death or property damage, WHETHER CAUSED BY THE NEGLIGENCE OR CARELESSNESS OF Yvette Gorman-Holmes OR OTHERWISE, except to the extent caused by Yvette Gorman-Holmes’ gross negligence or intentional misconduct.

This includes injuries or damages arising out of the negligence of Trainer, whether active or passive, or any of Trainer’s affiliates, employees, agents, representatives, successors, and guests. including, without limitation, any loss or theft of any personal property, whether arising out of the negligence of Yvette Gorman-Holmes or otherwise.

As with all personal development, fitness, coaching and consulting services, I understand that there are no guarantees of results because all outcomes are directly related to my unique ability and effort applied to implement the tools provided.

VIDEO/PHOTO RELEASE FORM

I grant and authorize Yvette Gorman-Holmes, Gorman-Holmes International LLC and Greatness in Action Wellness Consulting the right to take, edit, alter, copy, exhibit, publish, distribute and make use of any and all pictures or video taken of me to be used in and/or for any lawful promotional materials including, but not limited to, newsletters, flyers, posters, brochures, advertisements, fundraising letters, annual reports, press kits and submissions to journalists, websites, social networking sites and other print and digital communications, without payment or any other consideration.

This authorization extends to all languages, media, formats and markets now known or later discovered. This authorization shall continue indefinitely, unless I otherwise revoke this authorization in writing. I waive the right to inspect or approve any finished product in which my likeness appears, including written or electronic copy. I agree to this release without being compensated. I waive any right to royalties or other compensation arising or related to the use of the photograph.

I understand and agree that these materials shall become the property of Gorman-Holmes International LLC and will not be returned. I hereby hold harmless and release Gorman-Holmes LLC from all liability, petitions, and causes of action which I, my heirs, representatives, executors, administrators, or any other persons may make while acting on my behalf or on behalf of my estate.
